According to VISX's 10K, their patents have been the subject of litigation against some bozo named Dr. Taboada: the company says his complaint is without merit, and we know VISX has a good history on the legal front. But the 10K does say "an adverse determination could adversely affect VISX's future results of operations," and there is some Street chatter about some recent action on this. Does anyone know if that is why the stock is down, or just because they missed the whisper number?
