I have been looking for the answer at the FCC website with not much luck. I would think that if Leap does not qualify Leap would have the opportunity to correct the disqualification or not get the discounts available to "designated entities".

Excerpt from LWIN's press release:

SAN DIEGO - December 31, 1998 - Wireless communications
carrier Leap Wireless International, Inc. (NASDAQ: LWIN) today announced that it expects to file in a timely manner its response to the comments and opposition received by the Federal Communications Commission (FCC) regarding Leap's pending acquisition of wireless licenses in North and South Carolina from AirGate Wireless, L.L.C. The comments challenge Leap's status as a “designated entity,” which entitles small businesses to preferential pricing and payment terms.

Leap strongly believes that it meets all the FCC requirements to obtain approval of the license transfer and will support its conclusion in its response.
