I think the key is consent, but I was looking at the (over?)generalization of one way sex as rape. For a complex possibility, consider a man having sex with his wife who is in a vegetative state or possibly brain-dead. He might plead to a kind of generalized consent resulting from the marriage. Or that she was not alive in some sense so that act could not be rape but necrophilia. Something for the lawyers and moralists on this thread.
