The Recording Industry Association of America launched a failed lawsuit against Diamond in October to prevent shipments of the Rio, claiming it would be used to play bootlegged music.

MP3 technology lets users easily copy and distribute near- compact-disc quality music over the Web. San Jose, California- based Diamond operates a Web site, Rioport.com, where digital music is available.

Rio's popularity spurred recording industry executives to begin a series of meetings to develop alternatives to MP3 that would deter illegal copying of copyrighted music. There are an estimated 500,000 songs available in the MP3 format on the World Wide Web, many of them pirated.
