i was asked by PM about this, and i figure i would just post my response on the thread.

I spoke with ASTN about a week ago:

"Q: Does ASTN foresee any problems from the acquisition of PHLX by AMEX?

A: we do not believe this deal will take place."

They obviously already knew merger wasn't happening when i spoke to them.

My take? No problem.

One of my other questions was "DO you plan on applying to the NASD or NYSE or any other exchange for use of the VWAP trading system"

Their reply was that, no, they were not applying. Any institution that wished to use the VWAP system can do it at the PHLX exchange and it wasn't necessary to apply to other exchanges.

As far as the PHLX/NASD deal falling apart, i see it as a positive. What if the merger went through, and they asked for review of the VWAP system before implementing it?
