1. It is in T's interest to have a competitive market. That protects T's long term interest. You have to seek competition in order to prosper. I know this is difficult to understand since it seems to undermine your short term interests, but it is unavoidably true.

2. An RR-ATHM merger is not in anyone's best interest. You need competitors in order to have a separate and distinct market with all its advantages. I have preached this for almost two years and the FCC is confirming this obvious conclusion.

3. The calculations of lawyers go only so far as existing law. The FCC purview is not written in law. They now have powers only implied and there are other factors in the public domain which will be brought to bear against this tender.
