When you seek to conquer you must vanquish or others will rise up against you and you will be defeated. That means T needed to tender at a level that they couldn't pay in order to put it out of reach. Thus, they shouldn't have tendered.

It is the will of the people that needs handling. Handling the public doesn't seem possible if the minority view as represented by AOL, TWX, consumer groups, and municipalities, suddenly gets a big boost from the monopoly brainwashed fearing public.

There is a rising tide away from the constructive capitalist attitudes which have dominated this country for the last 10 years. Resentment among the non-participants in the stock market bonanza is quietly growing. Anger over not getting their fair share will show up in compensation and law. The proof of this changing attitude will be seen when the public is whipped into a frenzy by opposing forces and demands conditions on the tender that would undermine the point of making it.

The most popular error made in investment is that someone big knows all about what they need to know. When you join the ranks of the big, you find a bunch of scared kiddies flying by the seat of their pants. To believe that big money and lawyers create reality sinks you fast. You will find that such hubris invites the opposing forces to marshal their big money and lawyers to oppose you. The wise course is to operate in silence providing good products and services. T instead is following the way of MSFT

In this case Armstrong's move chases UMG away and puts their entire cable strategy at risk. If they lose UMG, the chickens are free to leave the roost. Perhaps, T had no choice since the Comcast situation was so pivotal as evidenced by their complete reluctance to say anything and the complete failure of the news media to pursue the issue. I tried to bring this out in my March comments, but the thread was only interested in attacking me. So tell me about public fears and the resulting hysteria.
