I'm inclined to agree with you that it's not Nasdaq's fault for a couple reasons:

1) At any other time during the day I can be pulling an equally heavy or heavier data load and not have out-of-sync quotes. Very often, when this happens at the open, it's not even a stock that is trading heavily.

2) I noticed that someone who uses the same firm as me has posted that his quotes are out of sync but reverse to mine: his Level II lags, whereas in my case it is T/S that lags.

I use RR cable internet and have very good trace-routes (at least they seem good to me). Here's a few:
