You may have a contract with someone and you may both ignore it and repudiate it. However, if it is not altered in writing and countersigned, and if one party goes to court ot enforce it, you will end up with a court order for compliance or remedy for non compliance with the specific terms in their legal meaning as determined by the court.
If the Black's Law dictionary provides a different legal meaning for the terms than what you thought, it means that you need a better lawyer to advise you of what you are signing.
A contract is a contract and you are generally stuck with the legal meaning of the terms that you signed off on. And granted that you cannot contract yourself into slavery or to do a criminal act, but we are talking about a business contract to explore for minerals and develop a resource here.
If both parties intended something different, they could just sit down and ammend or write a new contract.
Someone wants the issue decided in court and they will have to be satisfied with the rules and remedies that the court may grant.
