They didn't make a patent announcement because the patent has been filed but not yet granted. We can hear something any day now (should be good for a couple of points as the ignorant masses jump on).

Vivus has not yet released the name on the product but the VLAD's DD shows it will be an already established safe and effective drug that will be delivered transurethrally and thus protected under Vivus' tranurethral delivery patent.
