The court appointed receiver decides - they more than likely always take the highest offer, to satisfy the debt holders. Shareholders have no say whatsoever. Like I said, they are last in line. Alfred Balm is owed by some shareholders, not by FMA (if I am not mistaken). He therefore has no say at all, unless he is willing to make a higher bid for the Company.
