That is, indeed, what ATHM and RoadRunner would argue if they did try to merge. It seems to be the way Jermoluk sees it. But now try to imagine what the response might be. Pick a few entities among dozens who might object. Let's say, WCOM. If AT&T retained significant control of the merged entity, don't you suppose WCOM would see a threat to its internet backbone business?

Consider also: AT&T has objected every step of the way to each of the RBOC mergers. Their lawyers have filed just about every kind of legal roadblock that can be filed. Do you think the RBOC lawyers who represent companies forced to provide open access to their DSL lines are going to accept that argument?
