Forebearance from bringing suit can also provide consideration (I won't sue you if you sign this contract). The courts generally will not look at the adequacy of the consideration, only that there is consideration (ie. "for value received").

I suppose quasi-contract theories could give a right to relief (unjust enrichment). Or, mutual mistake could allow for rescission, so who knows (Common basic assumption = the patent is valid).

I'm not an expert, but I do know that the law doesn't like people to sit back and let somebody else save the day.

Oh well, good opportunity to buy today at 8, but I chickened out.
