If they have publicly stated that they aren't journalists or reporters then about all that is left is that they are a company that simply collects a fee to publish a release that they hold no responsibility for. If this is the case how can they claim they were damaged by something that someone else is responsible for? The trademark claim was taken because of a parody, is that actionable? Well it certainly seems to be, but is there claim strong enough to win? In my opinion out of 100 jurors I would say they could probably convince 2 to 4 of them that they deserve to be awarded any damages.
