Marimba, Inc. Responds to Novadigm Claim
PALO ALTO, Calif., Aug. 27 /PRNewswire/ -- Marimba, Inc.(TM) stated today that the patent lawsuit filed against Marimba by Novadigm, Inc. in March 1997 is baseless and without merit, and that it will continue to pursue its interests vigorously in court. Marimba believes that Novadigm's patent simply does not apply to Marimba's leading, independently-developed Castanet(TM) technology.

Additionally, Marimba believes allegations by Novadigm about the Distribution and Replication Protocol (DRP) are so vague as to be meaningless and amount to nothing more than empty posturing. Marimba and other industry leaders made the DRP submission to the World Wide Web Consortium this past August 25.

"Lawsuits and allegations like today's are unfortunate in that they slow innovation and are a tactic often used by companies who have otherwise failed to execute effectively in the marketplace and have no other way to compete," said Kim Polese, CEO of Marimba.

DRP is a proposed open standard that is designed to dramatically eliminate the congestion and bottlenecks associated with distributing information across the Internet. The DRP proposal represents a collaborative effort by many industry leaders focused on standards-based Internet computing. As a normal part of the standards process, DRP is open to all for comment and enhancements. Marimba and the other co-submitting companies are confident that the open DRP standard will become a powerful technology for all of the Internet to use.
