I
think it would be interesting to see which of the BW principals have an account at SI,
and what their 'names' might be.

An excellent idea for discovery.

I'm sure the fateful three have competent counsel, but no lawyer knows everything. Perhaps the best way those of on SI could help is by suggesting either legal strategies (such as a counter-claim for defmation against the three for accusing them of fraud; possibly barratry) or suggesting good questions for discovery (such as: identify all individuals who to your knowledge suffered financial loss from allegedly relying on the truth of the "press release" and the amounts of their losses; have there been any press releases or other documents posted by [company name deleted] which have proved to be less than 100% accurate? If so, in each case, identify the document, the person or company which prepared it, the date it was posted, the nature of the inaccuracy, the efforts [company name deleted] made to determine its truth or falsity, the names of all persons known or believed to have been injured by the falsity and the amounts of their injury, and all steps which [company name deleted] took in response to the partially or wholly inaccurate posting. Produce copies of all such partially or wholly inaccurate postings, and copies of all documents having any bearing on [company name deleted]'s responses to it.)

There are a whole lot of other fun interrogatories or requests for discovery which could be promulgated to establish that [company name deleted] did not in fact make reasonable efforts to protect its alleged credibility, and were contributorily negligent in posting the allegedly false press release.

Who knows; maybe we'll come up with some ideas the fab three's lawyers haven't thought of!
