Just received a call from a major trader. He strongly believes that the shorts are throwing all they have heavily at Vivus when it hits the mid 5's. They know they are screwed if we move and close above 6. The only thing is that if some institutions start jumping in now they will have just set themselves up for a lot more serious pain and will then just be fueling their own demise. The resolution of the lawsuit coupled with the information presented at the AUA meeting coupled by the much improved fundamentals on the R&D front IMO will soon result in some serious institutional accumulation of Vivus stock.

Some news we can expect in the near future that may just be the first real nails pounded into the short's casket:

1)PE patent announcement
2)MUSE launch in Germany info released by A/Z
3)Some "reputable" journalism revealing the current death toll on Viagra patients globally (IMO VERY sick numbers).
4)Milestones from Spain and Italy ASA licensing is announced.

The shorts can F### with the stock for only so long now. Their days are numbered. We have been waiting a long long time for justice and a day is nothing compared to what we have already endured.

PS We need to find out how long it is expected for the courts to approve this settlement.
