Jim, I am referring to the annual report we just received. If you have not seen it, it goes into quite a lot of detail regarding Imperial's handling of the well and it's testing. It's obvious from McLeod's point of view that they are lying, stone-walling and, in general, attempting to keep BEA/STP out of the loop and in the dark.
One example was the timing involved for BEA/Stp to raise objections to test results and the procedures used to get those results. Contractually, BEA had 24 hrs, or so, to raise objections. If the complaint was not registered in that time frame, it be came a moot point and Imperial could ignore it. They sat on results for several days, knowing McLeod was prepared to disagree, finally, faxing the information very late in the day on a Friday, after Bearcat's normal business hours. Only by chance, did someone return to the office and discover the fax and then alerted McLeod. Had that not happened, BEA would have discovered the fax on the next monday AM, several hours after the deadline and would have lost the chance to object, legally.
For a big company, like Imperial, to go to the lengths they did, there has to be a reason.....Tom |
