There is nothing in your post that I would or can differ with, especially that the IRS rules are arcane causing considerable grey areas. Even the courts have contradicted themselves as to trading vs investing.

It was not my intent to imply any causal effect on specific market activity, rather only to indicate the necessity of more specific IRS clarification, given the growth of online trading.
