Settling out of court is in the best interests of both MRBA and NVDM.
Both managements are too busy in establishing their companies, without having to worry about legal matters. The above article also shows that NVDM management realizes that it needs to work on both "increasing the sales/marketing force" as well as "brininging attention of analysts to the company's recent good earnings and forward potential".

I sure hope that NVDM management realizes that they can attact the market faster through the OEM channels rather than building their direct sales force. A small company like NVDM has to partner with "server hardware sellers like DELL/IBM" to bundle up their software with those servers at the selling point itself. The license revenues would sure beat out the time/energy they have to put into building a direct sales force and compete against big muscles like MSFT or IBM.
This hopefully would be their first priority before moving onto acquiring other companies, just for their better sales channels.
