Barb, if the ban is warranted, then they are not innocent for violating it, anymore than a speeder is "innocent" because he does not have an accident....
Can you grow the raw materials in the States? Refinement is not "making"...
Alcohol is indeed pharmacologically different enough than most of the banned substances. The effect of heroin is obviously much more powerfully incapacitating and addictive. Since I outlined the other points contributing to the futility of Prohibition elsewhere, I will not be repetitive, but they are obviously inapplicable to most controlled substances...
A criminal is someone who breaks the law. The only question is if there is sufficient reason to enact the statute....
Having said that, I do think that many laws aimed at users are too harsh...
