Dave, your last paragraph may be the best argument against certain conservative initiatives that a libertarian could mount. However, decisions about the limits of rights are being made and implemented all the time, and the question remains always: what constitutes a tolerable level of risk for the harm that might come of various practices. Your attempt to distinguish between intended harm and that for which the user is responsible is reasonable, but let me ask you something: if I knew that I was giving a gun to a person who meant to kill a roomful of people, would it suffice to say that it was his responsibility, not mine? If I gave the gun to someone whom I knew to be suicidal, but did not know him to have formulated the intent, what would be my responsibility? If I sold something that I knew to be ordinarily or even commonly abused, such as heroin (supposing that it can ever not be abused), what would be my responsibility? Even if the user of heroin were held to have a right to use it, does the vendor have the right to sell it?
