I meant that popular opinion is irrelevant in an individual case, and should not be brought to bear on the finder of fact. The issue is whether something did or did not happen, and what are the legal consequences of the existence or non-existence of that fact.

Consensus is, of course, important for the adoption of laws, which are general and prospective in nature.
