The fair value of the bid does not enter into the definition of what is a permitted bid - the bid could be $2/share and still be "permitted" provided that the bidder allows the GLE board 45 days to line up their ducks.

Maybe,...... In your example the $2.00 bid would be flatly refused as an opportunistic bid with no redeeming qualities and would be turned down by the board...without approaching the shareholders for approval...so, although a permitted bid, the bid would not see the light of day. That is why I used the term fair value.Ultimately we are saying the same thing. My impression only.
