In my opinion, the lawsuit is not a positive, but it is certainly not a deal breaker.

Whether or nor the batteries (1) are better than existing li-ion cobalt batteries out there for cellphones or laptops, and (2) can be produced efficiently on the NI lines for both product categories - these are deal breakers.

The ability to close a contract prior to the end of June and have the alternative of public rather than private financing - to me this is an impediment, but not a deal breaker.

I believe that the current Valence batteries out in the market are better than existing li-ion batteries currently being offered. And I believe that product improvements in existing li-poly technology will "obsolete" current li-ion technology - reasonably quickly.

So I don't worry about broker or market-makers' positions, since they are irrelevant to the long-term success of this or any other company - they just reflect the short-term perception of any company. If you or any other investor "buys into" Lev Dawson and the potential represented by their li-poly products, then feel comfortable with the stock and the company. If you don't, wait, or buy a competitive product.

I'll hold.
