At that point he has an opportunity, typically to a different judge, and now in a criminal situation [notice the penalty of higher stakes with this kind of objection] to explain how the judges order was not legal. I've never said it was only an objection. [That is from memory, and not research. Just a way I wished I put it earlier. It is a hypothetical kind of expression.]
