If there is a redoing of this deal it will be for all shareholders regardless of whether they tendered their shares or not.

Sure! But by tendering your shares, you are voting for the GEC deal to complete. And you can't 'untender' them now. What do you think shareholders would do (or have done) if they read a press release that read:

FORE Systems management has declined a lucrative buyout offer from Tellabs/Ericsson worth $40-45 a share in favor of a $35 cash deal that protected their positions in the company and provided them with substantial kickback.

Now that shareholders have been informed of what's going on in plain terms, it may be too late. Terms of the GEC deal made sure that large blocks of stock were committed before it was even announced.

I'd much rather have a half (or .4) a share of TLAB than $35 anyday...
