It's price fixing, which is per se illegal everywhere ("any combination or conspiracy in restraint of trade --- no one has to be injured for a combination to be illegal). Second, it's theft from the seller of the item who gets less than he would receive from open competition. Third, it's bid rigging (unfair competition. You may have been a defense attorney too long <g>.
