I don't find it unbelievable at all. Having heard Shay, and Blair, and Clinton, I think it was to be expected that they would try as hard as possible to avoid any review of the legality of their actions.

They know this action is unlawful. As long as only the Yugoslavs and Russians say it, it doesn't matter.

But if the World Court of Justice says it, the political dynamic changes dramatically, and the whole concept of New World Order (the new British-American World Empire) is threatened.

It is sad. But perfectly believable.
