Ethics lie above the laws because ethics refer to Justice whereas the latters rest on the arid concept of Order.
Obviously, building an arbitrary, human order and then trying to enforce it through some legal bodies and police forces is much more easier than routinely philosophize about the vague notion of ''Justice''. But human History has demonstrated that the latter attitude was very often associated with ''Progress''. Just think of the Nazi 3rd Reich: Hitler could also back up his evil regime with an army of faithful lawyers but here again, History showed us that Order and Justice are two different fields.
