I know of no "application" that precedes the filing. . . Bottom line: Either a company files their financials or they don't. . if they DO, then . . .if they are lying, then they are held liable and can be prosecuted for fraud by Federal Agencies in a Federal Courtroom. This one act brings quite a bit of legitimacy to a company. . .and that is why we draw a HARD LINE here.

No filing, no Federal Agency involvement. Company lies and you lose? All you can do is sue in a civil case. . .proving fraud would be far more difficult and burden would be on you and not the Feds, as I understand the laws regarding the pennies. I may be off somewhat here, but I doubt I am off by much.
