Hold on there friend, You are a PAID PROMOTER. You DO NOT have the same "free speech" protections that the rest of us do.

In your capacity as a PAID PROMOTER, you clearly posted "...any shareholder of record as at May 20, 1999 is guaranteed to receive the TIPS dividend." This differs from merely posting general information. As a PAID PROMOTER the SEC's Title 17 and other laws require a much higher level of due diligence to be performed.

Now you are back peddling on the above statement. In other words it appears at this time that YOU posted, while being compensated for doing so by the Company, MATERIALLY FALSE AND MISLEADING INFORMATION. In LAW it matters not if you were or were not PURPOSELY MISLEADING investors, as to awarding civil damages. Intent is important only so far as criminal sanctions and civil punitive damages go, IMO.

You claim at Message 9713067 that "In the case of TNRG / TIPS dividend information which investors have learned was not 100% accurate ... as originally thought by TNRG management. This is in no way catastrophic..."

NO WAY CATASTROPHIC?!!!!

Anyone who bought on or before May 17th and held TNRG at the close May 20 (May 17th) and then SOLD at a substantial decrease in share price EXPECTING AS THE OFFSET TO THE LOWER PRICE THAT THE "TIPS" DIVIDEND WOULD BE HIS "GUARANTEED" has indeed incurred a SUBSTANTIALLY MATERIAL IRREVOCABLE LOSS.

As the paid promoter federal laws (SEC) as well and the investor/banking laws of each of the 50 States put the burden on the Company and on their PAID PROMOTERS.

If any Company official or Paid Promoter happened to SELL SHARES just prior to the May 18th date, any faux claims that "we didn't Know Any Better" will fall on deaf ears, IMO.

We need answers NOW. Those who sold TNRG on May 18th and afterwards, the ones who were GUARANTEED by the Company and their paid promoter, that they would own TIPS on those shares, are they or are they not going to receive that dividend???

If the answer is "NO" as I think is it turning out to be, then the Company and the Paid Promoter should indicate immediately how they intend to recompense those selling shareholders who were hurt (and are continuing to be hurt as people sell every day while no official retraction has been made) by the irresponsible postings of materially false and misleading statements.
