If you will remember, Richard Rosen is the former Chairman, C.E.O and President that was sacked by the board and later sued.

Regarding that suit, an arbitrator found "Rosen failed to discharge in good faith the duties of his executive position and also failed to act under the directions of the companies board of directors." The arbitrator awarded BSFE an $800,000 judgment against Rosen.

There can be little question but that this is an attempt to delay the enforcement of that judgement.
