Richard, this "tax heaven" has been eliminated in the new tax code, at the end of the year you must mark your shorts to market and report the "paper income", furthermore, if one shorts against the box, the holding period on the long position is restarted from the closing of the boxed position, thus losing the "long term" status. They even eliminated the best tax evasion scheme, shorting a company that is going under and never paying the taxes since the short position is never closed (they got the mark to market at the end of the year to handle that tax loop), that one used to be a favorite in conjunction with the old reg s issues.
