This is precisely what AOL is asking of ATHM, as well. Is it not?
Recognize that I said it wouldnt be smart for AOL, I never said there should be new regulations forcing this behavior. AOL has every right IMO to create exclusive contracts, so does ATHM.
Dont forget also that AOL requires you start at aol.com (essentially) while an ATHM subscriber could go his entire life and never see www.home.net or www.excite.com.

We're back to the same set of conditions, then, as T/ATHM wanting to charge a premium for AOL on cable.
@home does not charge to go to www.aol.com. It is AOL that charges for that. That is AOL's choice. www.yahoo.com is free. So is www.excite.com. www.siliconinvestor.com charges though. Do they want a special discount from ATHM/T?

Its also worth mentioning also that with DSL you might desire a "better" ISP because the ISP is likely to be a limiting factor in performance. With cable the limiting factor is much more likely the provider of the line (the MSO) than the ISP.
This does bring up a point however-- what services are there (such as VPN) that people will want that cant be done through @home (basic IP)?
