Eli, I agree with you in general, but if they actually shipped product that is now in an actual laptop from Toshiba, and not just for show and tell, but for sales, this is a material event, which they should disclose (unless Toshiba muzzled them, also possible, but unlikely?). It is not a plan to ship or a "conditional order, or even a "shipable order" if the stories are true, it is a "shipped order". No one can sue for publicizing a landmark order. As a matter of fact, from a marketing point of view, such publicity would nudge others to come to the table and place their orders, and the company would be remiss in avoiding publicity. It is because of this reasoning that I believe the report might not be of a bona fide order, but at most a "trial" shipment, if not a figment of someone's imagination. If that is the case, the company is right in keeping mums about it, IMHO.
