It seems to me that any shorter can only be such when he does it with the broker's knowledge.No one can buy any shorted stock off the sidewalk.
The only ones responsible ,from the point of view of any share holder,is the broker from whom the shares were bought .I'm not a lawyer,but it would seem logic to me. The broker is the one which collects fees on any transaction and therefore he is responsible.This may mean that the broker which allowed the shorting might be the responsible one,not the one which sold them,however the latter is the responsible one to the shareholder.
