Hmm... ok reconcile this for me.

While Barksdale is saying this in court:
''The reason people get their product today is because it comes with the computer from the store,'' Barksdale charged from the witness stand. ''Or the reason they get it today is because it's given to them or presented to them by their Internet Service Provider. That's over half the distribution channel for this industry and we're basically out of that.''

At the same time figures prepared as part of the discussions preceding the purchase of Netscape by online provider America Online in November say:
" 22 percent of computer makers shipped Netscape Navigator and 24 percent of the top 20 Internet Service Providers offered Netscape."

Now the other half of the distribution channel is probably the internet itself. So while he is pleading that he has NO distribution channel he places in the documents:

"160 million copies of Netscape's Web browser had been distributed over a year."

22% of the top computer makers, and 20% of the top ISPs, and 100% of the internet users.

I say he lied to someone... and Judge Jackson is going be real curious to see who. If they call him again, and put him on the stand, he is going to look like a competitor that is crying wolf.

The judge NEEDS to hear that CONSUMERS have been hurt, not multi-billion dollar companies.
