What's the problem? The NYT has a copyright on their list, they own it - why shouldn't they defend it against use that they are not party to? They can decide to do deals with B&N just as Amazon can decide to do deals with whomever they wish. Don't you think Amazon would sue if I decided to publish a web site named www.Amazonbooks.com?
