Esentially, T doesn't need to provide the service if it doesn't want to. Portlanders will be out of luck here as T has already said they will bypass Portland. What do these Portlanders think they accomplished? Plus based on the arguments made it doesn't seem that T had its "A" team of lawyers on this one. Should get overturned as a taking or intereference with TCI's rights to sell its system to T. Afterall, TCI had a valid expectation that its lines did not have these open access conditions and Portland seems to be taking that right away thus reducing the value of TCI's plant and equipment and thus its value to would be buyers, in this case T.
