There's a lot of "sideband: business where deals are struck after the auction on items that did not meet reserve.

That is just the nature of the beast. The only way eBay could prevent it would be to hide the e-mail addresses unless the reserve price was met, but they would also have to hide the identity of the seller, which would be a very bad things for them to do.

So, yes it is a problem and there is very little they can do about it without becoming very user-unfriendly.

It's like the software business - they tried for years to stop piracy through fancified copy protection schemes, which, in the end hurt the legitimate buyers more than it hurt the thieves.
