I'm not worried about ISPs and telcos. Of course, ISPs will be able to offer DSL. The problem is cable companies. Would they have to allow every ISP to hitchhike? That would include ISPs big and small. That could be thousands of ISPs available like premium channels on on cable. The bandwidth necessary to do this is probably beyond even cable's ability to carry signals. Also, cable is not a public utility. The phone company is. As what's called a common carrier, the phone company can't turn away business if the guy pays his bill. Cable companies can turn away channels. My Comcast doesn't have CNNfn.
The basis of the Portland decision was the contract between the city and the cable company, not public policy common carrier law.
Actually, if cable were opened up across the board, ATHM would obviously be a loser due to its current almost monopoly position but AT&T, even though it owns a large chunk of ATHM, would get paid no matter who used their cable.

DENVER, Jun 7, 1999 (BUSINESS WIRE via COMTEX) -- Microsoft Europe highlighted growing signs of momentum for the Windows CE platform with the announcement today that new color palm-size PC products are outselling 3COM PalmPilot products 3 to 1 in France. Early feedback from retailers indicate similar results are expected in other European markets for new products recently introduced from a range of partners including Casio, Compaq, Hewlett Packard, andPhilips.

"Microsoft's Windows CE on the new Compaq Aero palm-size PC has drawn in three times more customers into our central Paris store than previous numbers and the new device is now outselling all other palm products. This is a record for a new product launch," said Mr. Dewavrin, CEO of Surcouf, one of the leading PC and software retailers in France. "We clearly sense momentum shifting in favor of products based on the Windows CE platform."
