J.Cicconi on CNBC. A big joke. It is clear what ATT legal strategy will be. In a nutshell, equate the Cable/Broadband to the Telecom Act of 1996.
Cicconi said that courts in small municipalities cannot legislate on
the cable issue and they will be overturned in the same way that a court which ruled that the 1996 Telecom Act was unconstitutional was overturned.
Cicconi is quite confused:

The Telecom Act had to do with OPENING the airwaves to competitors. A noble idea, gg. That's America.

The ATT approach is to hog and close competition in what can now be considered a COMMON CARRIER commodity: fiberoptic cable.

At the same time Cicconi talks from both sides of his mouth and says that " ATT recognizes the need to be open, ( gg can you believe that? ), and " wants to talk to AOL and others about how to do it ".

Yeah, right,
