NEWS FLASH: FEDERAL JUDGE RULES THAT AT&T MUST OPEN NETWORKS ------------------------------------------------------------ On Friday June 4th, a Federal Judge in Portland Oregon ordered AT&T to allow competing Internet Service Providers (ISPs) access to the long distance giants' cable systems. The OpenNET Coalition hailed the decision as a victory for consumer choice and the right of local communities to encourage competition in the Internet marketplace. Additional information, including the text of the Portland Ruling and links to news coverage on the decision is available on the OpenNET Coalition Web Site opennetcoalition.org BACKGROUND ----------- AT&T sued the City of Portland earlier this year saying that it did not have the jurisdiction to require the company to open its cable monopoly to allow Internet Service Providers to have access to its networks. But U.S. District Judge Owen Panner disagreed, ruling on a summary judgement in favor of the city. The case has been closely followed by thousands of local communities across the country that also will be deciding whether to require open access as a condition of allowing AT&T to take over the cable franchises of TCI. AT&T acquired TCI in a billion deal last year and is now seeking to transfer the cable franchises held by TCI in cities across the country. Charles Brewer, CEO of MindSpring and a member of the openNET coalition, said the judge's ruling "sends a message that the people are more powerful than AT&T and that local communities have every right to require fair competition." Other cities, including Los Angeles, California, are in the midst of similar battles.
