Note, the company referred to below is Ramtron (RMTR), not Rantron, and is not to be confused with RMBS. RMTR has rights to certain memory technologies including FeRAM (non-volatile) and EDRAM (enhanced performance).

NEC Gets Sued For Patent Infringement

The International Trade Commission (ITC)agreed Monday to accept a
patent-infringement case by Rantron International's Enhanced Memory Systems subsidiary against NEC. The Colorado Springs, Colo.-based company alleges NEC's Virtual Channel faster-speedDRAM chips violate its patents.

Enhanced Memory Systems last October filed suit against NEC in the San Francisco federal district court charging similar patent violations. That case is still pending.

The ITC investigation under Section 337 of the Trade Act lets the agency bar the importation of any foreign-made product into the United States that has been found to infringe a U.S. company's patent. The FTC will appoint an administrative law judge to conduct the probe and make a preliminary decision that must be ratified by the full commission.

Section 337 cases traditionally take up to a year to reach a final decision, though the parties often reach a settlement before that time.
