It also explains why B&L can't get approval fast enough.

On a side note, I wonder how much issue overlap there is on the '388 litigation in TX with the FTC case. Although there is no stare decisis value of an FTC admin. decision, the fact that both cases involved the Trokel patent and allegations of fraud suggests the FTC decision could have some value as a litmus.
