Hi Daine,

Regarding your question about the SHM and obtaining pertinent information, I would suggest that you demand the details of the lawsuit ( injunctive relief )filed against James L.Magruder on May 13, 1999. Or perhaps fcm should make a copy available to it's shareholders who attend the meeting.

I also believe that fcm's 10Q filed 4/29/99 is in error. It states a lawsuit was filed on April 5, 1999 "to rescind an employment contract and to seek damages from a former terminated employee." Unless the lawsuit filed on April 5, 1999 referred to in the 10Q, was against a different employee than James L. Magruder, That filing is technically incorrect.

In either case, you should definitely be made aware of the contents within that lawsuit.
