Sure...it does not have to be the company that sues him. Any investor who suffers a loss could file a civil suit if his statements prove to be false. Say that Joe Blow receives a margin call and can't cover and then WSP goes to $10+...I think that Joe Blow might just file a civil suit against people who post declarations like that.
It is all well and good to have an opinion but you must state that it is only YOUR OPINION and whether you have any position in that particular stock. Otherwise one is quite liable.
