You know, that's a good question. A newspaper has a duty to publish the truth. Does that duty extend to every Tom, Dick and Harriett? You and I are just shooting the breeze here, are we required to censor ourselves and never say anything unless it was 100% accurate? I'd say not.

On the other hand, I certainly would never say potentially damaging things about someone else's business without making it clear that I was either expressing an opinion, or referring to publicly known facts and conclusions drawn from those facts.

But, if I were actually maliciously spreading lies in an effort to damage someone else's business, saying that it was just an opinion might not shield me.
