from MaxPC:
<<3dfx would not discuss the evidence in the case, but Danforth(creative) said the only evidence of infringement presented in the suit is that the two products use the same file names and command names.>>

And where did they get those file and command names...from Glide SDK and source, duh. They used the documentation and information in the Glide source code to develop their own version. That much is clear to me. So is the wording on the Glide SDK. It states explicitly that you CAN'T use any of the info for non-3dfx products. Now if they were to decode video games that used Glide to reverse engineer something that was compatible, that would be okay.

Peter, what about reading the article first, and then making any comments you want, i'm almost certain you didn't read it, it's not the same news that was post earlier, but if you don't read it you will not know. And not because something has already been discuss that you need to forget about it and move on.JMO

You will have to forgive me Marc. I was being sarcastic because that item about the suit against Creative was reported and had been discused here already. Wasn't intended to offend.

Creative Unified --

Peter S wrote

<<It seems to me that the gist of the defense
is that the Glide source code is not
duplicated in Creative's Unified Driver
product while 3dfx says, maybe not but you
used our source code as a guide in order
to come up with your code.>>

Any person who worked with the Glide source code is necessarily
contaminated by it, strongly so if that individual or even Creative
possesed any copies
of the Glide source code while developing "Unified".

If any such individuals worked on
"Unified", then that would be one basis for 3dfx's case, in
my opinion as a software developer.
